Terms.

The legal frame. What you can do with the Services, what we can do, and what neither of us can do.

Services means ingestlayer.com, the hosted pipeline (Frankfurt and Dublin regions), the dashboard, the SDKs (@ingestlayer/sdk, ingestlayer-py), and the publicly distributed engine source code.

We, us, our means ingestlayer, a German limited liability company.

Customer means anyone who creates an account or otherwise uses the Services.

You are responsible for the security of your account credentials and for all activity that occurs under your account. You will not use the Services to ingest, process, or route data in violation of any law, regulation, or third-party right. Bot signups and other automated account creation are prohibited. Sharing credentials across organizations to circumvent tier limits is prohibited.

You confirm that you have a legal basis to ingest the data you send to the Services. We are a processor for that data on your behalf; you remain the controller.

Hosted plans are listed at /pricing, billed in USD, charged in advance per month. The starter plan is free indefinitely up to 10,000 events per month. Paid upgrades take effect immediately and are prorated to the current cycle. Downgrades take effect at the start of the next cycle. Taxes are excluded; we collect VAT or sales tax where legally required.

Overage is billed at the rate published on /pricing, once at the end of the cycle, on the same invoice. We do not auto-upgrade plans.

Refunds are prorated to the day and issued from the dashboard, without phone calls or qualification.

You can cancel from the dashboard. We will not act on cancellations sent by email or phone. Your access continues through the end of the current billing period. After cancellation, we delete your account data from active systems within 30 days, and from backups within 60 days. Event payloads and stored entities — otherwise kept until you delete them — are removed on the same schedule.

We reserve the right to suspend or terminate accounts that violate these Terms, abuse the Services, or fail to pay. Suspension is preceded by notice except where immediate action is required to protect other Customers, our staff, or infrastructure.

We may modify the Services. Material changes that reduce functionality you depend on receive at least 90 days' notice and a documented migration path. Price changes for existing Customers take effect with at least 30 days' notice. Material Terms changes are communicated to all Customers by email. Continued use of the Services after a change constitutes acceptance.

The Services are provided on an as-is basis. The scale plan carries a 99.9 percent monthly uptime SLA, with service credits as the sole remedy. Starter and team plans do not carry an SLA. Data is encrypted in transit (TLS 1.3) and at rest (AES-256). Infrastructure runs in Frankfurt (Hetzner) and Dublin (AWS eu-west-1); all processing and storage of Customer data stays in the European Union.

The SDK is open source, published on GitHub. You may run it, modify it, redistribute it, and use it commercially under the terms of its license.

The hosted Services, the ingest engine, the dashboard, the marketing site, the ingestlayer name, and the brand assets remain proprietary. You retain ownership of all data you ingest, your pipeline definitions, and your event schemas. We claim no rights over your data beyond what is necessary to operate the Services on your behalf.

Total liability under these Terms is limited to the fees you paid us in the twelve months preceding the claim. We are not liable for indirect, consequential, incidental, special, or punitive damages, lost profits, lost revenue, lost data, or business interruption. These limitations apply to the maximum extent permitted by law. Nothing in this section limits liability for fraud, gross negligence, or wilful misconduct.

These Terms are governed by the law of the Federal Republic of Germany, without regard to its conflict-of-laws rules. Exclusive jurisdiction is the competent courts at our registered seat in Germany. If you are a consumer with mandatory rights under your home jurisdiction, those rights are unaffected.
